Vidal v. Elster

In Vidal v. Elster, a man sued the U.S. Patent and Trade Office (PTO) for refusing to register his slogan “Trump too small,” which he used on T-shirts and other merchandise mocking Donald Trump. Mr. Elster argued that the PTO is violating his First Amendment right to free speech by denying him a trademark on his slogan.

On June 13, 2024, the Supreme Court unanimously ruled that the man’s First Amendment rights were not violated by the PTO.
