Culley v. Marshall
Culley v. Marshall involved an individual’s right to due process when the state seizes their property. In this case, two women whose cars were seized by the police and held for over a year sued Alabama for denying them a timely hearing to determine whether their cars had been properly seized.
On May 9, 2024, in a 6-3 decision along partisan lines, the Supreme Court’s Republican-appointed majority denied vehicle owners the right to a preliminary hearing when their vehicles are seized by the state.
