Oklahoma Statewide Charter School Board v. Drummond
Court Accountability: “Oklahoma’s charter school board approved a taxpayer-funded Catholic school designed to obliterate the separation of church and state. The effort was too much even for the state’s Republican attorney general, who won his challenge before Oklahoma’s conservative supreme court. The Roberts Court then agreed to hear the case, but the justices ended up affirming the state supreme court by an evenly divided vote after Justice Amy Coney Barrett’s recusal left SCOTUS deadlocked.” (See Court Accountability’s full June Decisions Preview here.)
Out of 28 petitioner-side amicus briefs filed in this case, at least 3 were filed by organizations funded by or otherwise strongly connected to individuals with close ties to one or more Supreme Court justice. One brief in support of neither party was also filed by one of these organizations.
